Care Circle Terms of Service
Introduction
Effective date: October 29, 2026
These Terms of Service (the Terms) govern your use of Care Circle, including the website at carecirclehq.io and the application at app.carecirclehq.io (together, the Service). The Service is provided by Chympen (Care Circle, we, us, or our). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a daycare or other organization, you confirm that you have authority to accept these Terms for that organization.
Who Uses the Service
The Service is daycare management software for childcare providers anywhere in the United States. There are three kinds of users:
Daycare owners and administrators, who create an account for their program (the Provider).
Daycare staff, who are invited by a Provider.
Parents and guardians, who are invited by a Provider to view and manage information about their own child.
You must be at least 18 years old to create an account. Children do not use the Service directly.
What the Service Does
The Service includes tools for attendance, parent updates and messaging, billing, enrollment, waitlists, and child and family records. We may add, change, or remove features over time. We will try to give notice of changes that materially reduce core features.
Your Account
You are responsible for keeping your login details confidential and for all activity under your account. Tell us right away at info@carecirclehq.io if you believe your account has been accessed without permission. Providers are responsible for inviting only authorized staff and parents and for removing access when it is no longer appropriate.
Provider Responsibilities and Children's Data
Providers collect information about children and families and enter it into the Service. The Provider is responsible for that information and acts as the controller of it. Care Circle processes it only on the Provider's behalf, as a service provider, to operate the Service.
Each Provider agrees to:
Give parents any notices and obtain any consents required by law, including under the Children's Online Privacy Protection Act (COPPA) where it applies, and under state childcare licensing rules.
Comply with the Family Educational Rights and Privacy Act (FERPA) where it applies to the Provider, and treat Care Circle as a school official with a legitimate educational interest for those records.
Enter only information it has a lawful right to collect and share.
Respond to parent requests to access, correct, or delete their child's information.
Plans, Payments and Subscriptions
The Service is free for programs with up to 20 enrolled children. Programs with more than 20 children need a paid plan. Current prices are shown in the app or on our website.
Paid plans are billed in advance on a recurring monthly or annual basis and renew automatically until canceled.
Payments are processed by Stripe. By paying, you also agree to Stripe's terms. We do not store full card numbers.
You can cancel at any time in your account settings or by emailing info@carecirclehq.io. Cancellation takes effect at the end of the current billing period.
Fees are not refundable except where required by law or where we decide otherwise in writing.
We may change prices with at least 30 days notice. A change takes effect at your next renewal.
If a payment fails, we may limit or suspend paid features until it is resolved.
Prices do not include taxes, which you are responsible for where they apply.
If a Provider uses the billing features to collect tuition from parents, the Provider is responsible for its own fees, refunds, and agreements with families. Care Circle is not a party to those agreements.
Acceptable Use
You agree not to:
Use the Service for anything unlawful, harmful, or fraudulent.
Upload content that is abusive, harassing, or that violates anyone's privacy or rights.
Access accounts or data you are not authorized to access.
Interfere with, overload, probe, or attempt to break the security of the Service.
Copy, resell, or reverse engineer the Service, except as the law allows.
Send spam or unsolicited messages through the Service.
Use automated tools to scrape or extract data from the Service.
We may remove content or suspend accounts that break these rules.
Your Content
You keep ownership of the information and files you put into the Service (Your Content). You give us permission to host, store, process, and display Your Content only as needed to provide and improve the Service and as described in our Privacy Policy. We do not sell Your Content.
Our Property
The Service, including its software, design, and brand, belongs to Care Circle and its licensors. We give you a limited, non exclusive, non transferable right to use the Service under these Terms. If you send us feedback, we may use it without obligation to you.
Third Party Services
The Service relies on third party services such as Stripe for payments, hosting providers, and email delivery providers. Your use of those services may also be subject to their terms. We are not responsible for third party services we do not control.
Privacy and Security
Our Privacy Policy explains how we handle personal information and is part of these Terms. We use reasonable administrative, technical, and physical safeguards to protect data, but no system is perfectly secure.
Termination
You may stop using the Service and close your account at any time. We may suspend or end your access if you break these Terms, fail to pay, create risk or legal exposure for us or others, or if we stop offering the Service. Where reasonable, we will give notice first.
After an account is closed, a Provider may request an export of its data within 30 days. After that, we delete or anonymize the data as described in our Privacy Policy. Sections that by their nature should continue, such as payment obligations, disclaimers, and limitation of liability, survive termination.
Disclaimers
The Service is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not promise that the Service will be uninterrupted or error free.
Care Circle is a software tool. It does not provide childcare, legal, tax, or licensing advice, and it does not replace a Provider's own judgment, supervision of children, or legal duties. Providers are responsible for meeting their own licensing and recordkeeping rules.
Limitation of Liability
To the fullest extent the law allows, Care Circle will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service.
Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars. Some states do not allow certain limits, so some of these limits may not apply to you.
Indemnity
Providers agree to defend and hold harmless Care Circle from claims arising from the Provider's content, its collection and use of children's and families' information, or its breach of these Terms or the law.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in New York, and you and we consent to that jurisdiction. Before filing a claim, please email info@carecirclehq.io so we can try to resolve it informally.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app at least 30 days before they take effect. Continuing to use the Service after changes take effect means you accept them.
General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
